Man who murdered 11-year-old Carlie Brucia apologizes, cries and begs for mercy, reported the Ft. Lauderdale Sun-Sentinel:
Smith told [Judge Andrew] Owens Tuesday [Feb. 14] he had been a heroin addict since he was 19 and had unsuccessfully tried to quit several times. He said his wife had kicked him out of their home in January 2004 and he had lost his job. He said he took drugs trying to overdose and doesn't recall much of what happened the night he abducted Carlie.
"I lost my business, my family and my self-control," he said, as his mother, Patricia Davis, also wept in the courtroom gallery. "My world was really coming apart fast."
I think it would be entirely appropriate for Judge Owens to periodically turn to Smith's left, address empty air and say things like, "Carlie, did you also cry and beg for mercy when Mr. Smith killed you?" and "Carlie, did you feel like your world was also coming apart fast when Mr. Smith killed you?" and then after pausing for a moment say to the courtroom, "Carlie seems to be unavailable to answer the court's questions."
Play along! From the Miami Herald:
Smith told Circuit Judge Andrew Owens, who will sentence Smith to death or life in prison, that "I do not ask for mercy for myself. The only thing I can see to give me a life sentence is for the sake of my family. I do not want to see my children hurt any further."
"Carlie, do you think your life should have been spared for the sake of your family when Mr. Smith killed you? Can you tell the court from your own experience how concerned Mr. Smith is about not seeing children hurt? Carlie seems to be unavaiable to answer the court's questions."
Meanwhile, Andrea Yates' lawyers don't want the jury to see a picture of her seven year old son drowned face down in the bathtub. "George Parnham claims the photos could cause jurors to be unfairly prejudiced or confuse them." How very Orwellian: It seems to me the photos would fairly prejudice jurors and provide clarity.
